Terms and Conditions of Use

Please review these Terms and Conditions of Use (“Terms,” “Terms of Use,” or “Agreement”), which are a binding license agreement that covers your use of this site and any website owned or operated by Enclos Corp. or any of its subsidiaries or business units (collectively “Enclos”), including without limitation, enclos.com, ets-na.com, and coalitionglass.com, and any and all websites/domains currently in use or to be used in the future to provide content (the “Site” or “Sites”). If you remain at any Site, or return thereafter, you agree to be bound by this Agreement in exchange for access to the free content provided by Enclos. You agree to comply with these Terms of Use as well as all notes, warnings, and notices appearing on a Site. If you do not wish to be bound by this Agreement, please leave the Site.

Governing Terms

These Terms of Use, along with any additional terms and conditions that are referenced herein or that are presented elsewhere on the Sites and the Enclos Internet Privacy Statement, set forth the terms and conditions that apply to your use of the Sites. By using any of the Sites, you agree to comply with all the terms and conditions hereof. If you do not agree to these Terms of Use, you should not access or use such Site.

Changes to Terms of Use

Enclos employees are not authorized to vary the terms of this Agreement. You agree that Enclos, at its sole discretion, may modify or terminate the terms of this Agreement (or discontinue this site), without advance notice, and that your right to access this site is conditioned on an ongoing basis with your compliance with the then-current version of these Terms of Use. Your use of the Site after such posting shall be deemed to constitute acceptance by you of such modifications, additions, or deletions. Enclos reserves the right to add, delete, or modify any or all terms of use at any time with or without notice.

Copyright, Trademark, and other Intellectual Property

Except for public domain material, or as otherwise noted, the content provided on the Sites by Enclos is copyrighted. Enclos owns all rights to its logos and trademarks used in connection with the Site.  All other logos and trademarks, if any, appearing on the Site are the property of their respective owners.  All material contained on a Site, including, but not limited to all text, images, graphics, logos, and audio content, are protected worldwide by applicable copyright laws and treaty provisions. The material on a Site may not be published, reproduced, copied, modified, uploaded, transmitted, posted, or distributed in any way without Enclos’ prior written consent or as expressly permitted by the limited license set forth below.

Limited License

You are hereby granted a non-exclusive license to use the material located on each Site while connected to it. You are also granted a limited license to print copies of any material contained within the Site, but only for your personal use. All other rights are reserved. You may not electronically reproduce, adapt, distribute, perform, or display the material located on any Site except as necessary to review such material while connected to the Site. You may not make changes to any materials found within any Site or delete author attribution or copyright notices and may not commercially use any materials from any Site. Use of any of Enclos’ trademarks as metatags on other web sites is strictly prohibited. You may, however, establish ordinary links to this site without the written permission of Enclos.

Internet Links

Enclos may provide links from a Site as a convenience to visitors. Enclos has no control over linked sites and makes no representations about any content or material available at these locations. Links are not intended to imply sponsorship, affiliation, or endorsement with the linked site. If you believe that Enclos has provided a link to a site that contains infringing or illegal content or that makes available cracker tools or other circumvention devices, notify Enclos immediately so that it may evaluate whether (in its sole discretion) to disable the link.

The materials on Sites are provided for informational purposes only. The projects, materials, and details presented on a Site represent isolated features of complex, custom facade systems. Reuse of such features, in addition to being legally prohibited by applicable law and these Terms of Use, is hazardous without prior professional evaluation of applicable design considerations, building codes, structural engineering requirements, contiguous building systems, and assembly and installation capabilities and constraints. Therefore, with respect to the details, features, materials, and/or products depicted within a Site, Enclos makes no warranties of any kind, whether express or implied, including but not limited to warranties of title or implied warranties of merchantability, fitness for a particular purpose, non-infringement or otherwise. Under the laws applicable to this Agreement, neither Enclos nor any other person or entity providing content via this site shall be liable to you for any direct, indirect, incidental, special, or consequential damages.

Jurisdiction & Governing Law

The Terms of Use shall be governed in accordance with the laws of the State of Minnesota, in the United States of America, excluding its conflict of laws provisions.  Any and all disputes, claims and controversies arising out of or in connection with your access to, and/or use of the Sites, and/or the provision of content on or through the Sites shall be governed by and construed exclusively in accordance with the laws and decisions of the State of Minnesota applicable to contracts made, entered into, and performed entirely therein, without giving effect to its conflict of laws provisions, except to the extent that law is inconsistent with or preempted by federal law.

Severability

If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this Agreement and shall not affect the validity and enforceability of any remaining provisions. The enforceable sections of these Terms of Use will remain binding upon the parties. This is the entire agreement between the parties relating to the matters contained herein.

Miscellaneous

These Terms of Use and any operating rules for the Site established by Enclos constitute the entire agreement of the parties with respect to the subject matter hereof and supersede all previous written or oral agreements between the parties with respect to such subject matter. If you access the Site from any location other than the United States, you accept full responsibility for compliance with all local laws. You are also subject to United States export controls and are responsible for any violations of United States embargoes or other federal rules and regulations restricting exports. The section headings used herein are for convenience only and shall not be given any legal import.

Enclos Corp Privacy Statement

Enclos regards the safeguarding of Internet privacy as a serious matter. Although Enclos does collect information about the visitors to its web sites, the amount and type of information gathered depends upon how the web sites are used.

Normal Web Site Usage

When you visit a Site, Enclos may collect and store information about your visit on an anonymous, aggregate basis. This information may include the name of your internet service provider, the web site that referred you to the Site, the pages you requested, the length of time of your request, and the date and time of your requests.

Use of Collected Information

Enclos uses this collected information to generate statistics and measure web site activity to improve the usefulness of your visits. During normal web site visits, Enclos does not collect or store personally identifiable information such as your name, mailing address, email address, phone number, or social security number.

Web Site Interaction

There are times when Enclos will require personal information to satisfy Internet requests to receive company literature, submit a resume, or otherwise correspond with one of Enclos’ offices. You will be prompted for this information (name, mailing address, email address, type of request, etc.) at the time of your request. This information will be collected and stored in an appropriate manner and will be used to fulfill your request. If you tell Enclos that the information should not be used as a basis for further communications, Enclos will respect your desire for privacy. The information you provide to Enclos is used to improve the services provided to you and to other potential visitors to the Sites. The information will not be shared outside of Enclos.

Agreement to Use Personally Identifiable Information

When you submit personally identifiable information to Enclos, you understand that you are agreeing to allow Enclos to access, store, and use the data in any of the locations where Enclos does business. Enclos may use the personal information you submit for any business related purpose, including, but not limited to, generating statistical studies, conducting marketing research, improving products and services, sending you surveys, notifying you of new developments, or changes within Enclos that may affect you.

Disclaimers

Although Enclos will protect the privacy of personal information submitted through its Sites, Enclos will comply with requests for information or subpoenas from government officials or law enforcement officers that may require the disclosure of personal information or communications with Enclos.

Modification of Privacy Statement

Enclos reserves the right to modify its Privacy Statement as business needs warrant, or to better serve the needs of visitors to its Sites. Enclos will use reasonable efforts to publish any changes to its Internet Privacy Statement within a timely fashion.
